DUTERTE’S LEGALISTIC APPROACH TO BONG REVILLA’S RIGHT TO BAIL.

From these words alone, If we take a cerebral reading of those pronouncements we can conclude that Mayor Duterte is just stating the law, which can be found under Section 3 Rule 114 of the rules of court and Section 13 Article 3 of the constitution.

SENATOR MIRIAM ON DUTERTE’S ALLEGED EXTRA-JUDICIAL KILLINGS.

In an interview by Rappler  asking on what is her take on the alleged  Extra-judicial killings of Mayor Duterte,  the senator  said the following:

Mayor Duterte and I are alike, that’s why we are best friends because sometimes we descend to the level  of hyperbole. When you exaggerate what you are saying, so it becomes more effective, and it catches greater attention of the listeners but it’s not literally true. I think these accusation of a death squad, other terrorist actuation’s, if they had complaints, it should have been made a long time ago. These stories date back to even 10 years. So why didn’t they file a case?  When he says he killed a person, he might mean on his orders according to law. Because, there are police circulars on how you can kill at will, kill on site. There are regulations on how to kill a person according to law. Maybe, that’s what he means, but no one will say I killed a person and described it even. That would be an admission against interest and he will need a full panoply of judicial defense. So I thin k It can be disregarded unless there is weighty evidence.  It’s one of those things politicians sometimes say in an exaggerated way to catch the attention of the public.

COMELEC accepts Duterte’s COC

On December 17, 2015, COMELEC accepts Duterte’s COC. The COMELEC decision is based on Section 76 of the omnibus election code, because  under Section 76, the duty of an election official to receive and acknowledge a receipt of a certificate of candidacy by any person is only a MINISTERIAL DUTY, which means that the election officer has no discretion whatsoever in denying or accepting the certificate of candidacy filed by the aspiring candidate, for as long as the certificate of candidacy appears to be complete and regular upon its face. The Vice-President will be our 16th President

If Mayor Duterte has been declared winner and later on disqualified, the Vice-President following the law on succession will take his place as  the 16th President. We have 146 vice-presidential candidates, but the popular candidates among them all are, Bongbong Marcos, Allan Peter Cayetano, Leni Robredo, Chiz Escudero and Gringo Honasan. So if in the long run, Mayor Duterte has been disqualified, one of those Vice-Presidential candidates that I have mentioned will be our 16th president.

But what if in the 2016 elections, the 2nd placer questioned the succession of the vice-presidential winner of the vacant presidential seat? Can he ask that those votes that have been casted to the winning disqualified candidate be considered stray votes? and thereby proclaim him as the 16th President instead?
